Crash left me with a broken helmet, person who caused the crash won't pay

I just had to spend over $400 on a new helmet after a recent crash. (Lady pulled out on me from a stop sign.)Tried to get in touch but couldn't. Forwarded the cost onto the cops to give to the son of the 89 year old lady. Her insurance won't pay and he's flat out refused to pay out of pocket even though his mother could've killed me.
